The U.S. Department of Education has investigated San Jose State University regarding its handling of a situation involving the head volleyball coach amid a 2024 transgender scandal. Despite Title IX complaints, the university decided not to suspend the coach, citing concerns about media attention and team impact.
The findings, shared with Fox News Digital following a public records request, reveal that the university prioritized avoiding additional media scrutiny. An unnamed coach in the report, believed to be head coach Todd Kress, remained in position while another, assistant coach Melissa Batie-Smoose, faced suspension and non-renewal of her contract.
Batie-Smoose, currently pursuing a wrongful termination lawsuit, stated the university’s actions were aimed at minimizing attention. She was implicated in a Family Educational Rights and Privacy Act (FERPA) violation, a charge her attorney, Vernadette Broyles, denies.
Both coaches had Title IX complaints against them, but only Batie-Smoose was penalized. Kress allegedly also breached FERPA in an ESPN interview. The decision to suspend only the female coach is under scrutiny, with additional information requested from the university.
The report mentions an observation by the Title IX coordinator indicating a lack of communication with Kress. The university’s decision led athletes to express safety concerns, amplified by Batie-Smoose’s release. Former co-captain Brooke Slusser is involved in a lawsuit, echoing these worries.
San Jose State University and the California State University system have countered the Department’s findings with legal action. They are challenging potential federal funding cuts, with the court requiring joint status reports and an expedited process if funding decisions occur.
The outcome could affect the university’s federal funding eligibility, with no immediate actions affecting funding until court proceedings are resolved.
