Prosecutors are gearing up to present substantial evidence, including video testimony and text message confessions from Robinson’s former roommate, proving Robinson’s involvement.
Transparency and Controversy
Retired FBI agent James Gagliano has commented on the Kirk family’s call for transparency amid the proceedings, noting the presence of cameras inside the courtroom. There is ongoing debate about whether the death penalty should remain a possibility, as Utah prosecutors are adamant about maintaining it due to the risk Robinson allegedly posed to surrounding individuals during the shooting.
Defense Arguments
Robinson’s defense contends that the gunshot, which led to Kirk’s death, traveled from above the crowd, thus not endangering bystanders. They highlighted that only one shot was fired, targeting Kirk directly, without resulting in injuries to others. Nonetheless, prosecutors are tasked with proving an aggravating factor that establishes a broader risk to attendees at the event.

Following extensive preliminary hearings, Judge Tony Graf Jr. is scheduled to issue a decision on whether the case should proceed to trial on September 1. Robinson remains a suspect, having driven from his southern Utah home to Orem where he allegedly shot Kirk during a Turning Point USA event in September 2025. The suspect confessed to multiple individuals and surrendered promptly afterward.
