An unexpected incident led to thousands of East Coast flights being disrupted on Monday. A severed fiber optic cable was the cause, impacting many travelers. For those affected, U.S. law provides a right to a full cash refund, according to AirHelp’s chief legal officer, Eric Napoli, who spoke with Fox News Digital.

“Under U.S. domestic law on flights, you’re entitled to a full cash refund,” Napoli explained.

Travelers flying to and from Europe have different rules. European regulations provide compensation if the delay is due to airline faults, potentially up to $700. In this situation, the incident was outside airline control. The disruption occurred at the ground infrastructure level, meaning compensation under European rules is not available.

U.S. Transportation Secretary Sean Duffy attributed blame to Amtrak, alleging a construction crew was responsible. Amtrak refuted the claim, stating the incident occurred on New Jersey Transit property. NJ Transit confirmed its work at the location, emphasizing that the digging took place 10 feet from marked utility lines.

Given the cause of the delays was not airline-related, European travelers will not receive the $700 compensation usually applicable under European law. Napoli clarified, stating that such compensation requires delays to result from airline operations, like a technical fault with the aircraft.

Customers are eligible for full refunds as per U.S. law. However, if passengers choose to accept airlines’ rebooking offers, they waive their right to refunds. Napoli outlined the usual process, explaining airlines often offer an alternative flight or rescheduling. He advised that if travelers choose not to take another flight, they can claim their refund.

Proactivity is key. Napoli urged passengers to actively seek out refunds rather than waiting passively for airlines to issue them. He noted airlines may offer rebookings promptly via apps, but when it comes to food vouchers, accommodation, or transport, passengers must request these benefits.

Napolis highlighted that services like AirHelp provide resources and support, including 24/7 chat assistance and apps to track flights. He advised passengers to remain informed and approach airline staff with politeness, as remaining calm improves the resolution of issues.

The incident has prompted reactions from various parties. Fox News Digital has reached out to the Department of Transportation, Amtrak, and New Jersey Transit for their comments.
