Virginia Governor Abigail Spanberger has made a significant policy decision by terminating the cooperation between several state agencies and federal immigration authorities. This move was officially announced on Wednesday through an executive directive.
The directive concluded the 287(g) agreements, which involved the Virginia State Police, the state Department of Corrections, the Department of Wildlife, and the Virginia Marine Resources Commission, with the U.S. Immigration and Customs Enforcement (ICE). The governor stated, These Agreements improperly ceded discretion and authority over Virginia law enforcement to federal authorities.
She emphasized her confidence in Virginia law enforcement’s ability to keep the state safe by operating under Virginia law. The governor assured that the state is ready to enforce the law, with law enforcement officials empowered to act based on valid judicial warrants.
The 287(g) program is a federal initiative permitting local law enforcement officers to carry out specific immigration-related tasks under the guidance of ICE, such as identifying undocumented immigrants in local prisons to prevent their release back into communities. Since assuming office in January, Spanberger has rescinded an executive order that required state law enforcement and encouraged local agencies to deputize officers as ICE agents, according to her office.
Governor Spanberger emphasized her decision to shift focus back to essential responsibilities for Virginia’s law enforcement, which include investigating crimes, enforcing state and local laws, and ensuring the safety of residents, as highlighted in a news release from her office. The governor and other state Democrats have faced criticism from Republicans for minimizing cooperation between state and federal immigration authorities.
This decision follows ongoing debates about immigration policies, coinciding with heightened tensions in regions such as Minnesota amid federal crackdowns on illegal immigration during the Trump administration. The decision has garnered attention amid calls from Virginia Democrats for new tax proposals aimed at making daily life more affordable, despite criticism from opposing parties.
