A Utah judge has ruled that Tyler Robinson, accused of murdering conservative activist Charlie Kirk, will stand trial. The decision came after prosecutors provided sufficient evidence on all seven charges against Robinson.
Robinson pleaded not guilty following Judge Tony Graf’s ruling. The judge allowed prosecutors to continue seeking the death penalty, as the state showed probable cause for allegations against Robinson.
Viewed in the light most favorable to the prosecution, this evidence is sufficient at this stage to support a reasonable belief that the defendant is the individual who shot and killed Charlie Kirk,
Graf stated.
During the preliminary hearing, Graf explained that the standard was not to prove the case beyond a reasonable doubt, but to decide if enough evidence existed for a trial. Whether the state can prove the aggravating circumstance beyond a reasonable doubt remains for trial,
Graf added.
The charges against Robinson include aggravated murder and felony discharge of a firearm, both first-degree felonies. He also faces two counts of obstruction of justice, two counts of witness tampering, and committing a violent offense in the presence of a child.
Proceedings immediately moved to Robinson’s arraignment after Graf’s ruling, with Robinson’s attorney entering not guilty pleas.
Robinson’s defense team argued against cameras in the courtroom, worried about publicity’s impact on the case. However, Graf decided to permit cameras, following courtroom decorum rules.
Charlie Kirk, 31, died in September 2025 during his speech at a Turning Point USA event in Utah. Prosecutors accused Robinson of firing from an elevated position into the crowd.
Jeff Neiman, representing Kirk’s family, urged for a swift trial process, noting Kirk’s contributions to community building and advocating for dialogue on difficult topics.
Charlie devoted his life to building a community of over a million young people rooted in faith and freedom,
Neiman stated.
Robinson is scheduled for a court appearance on October 23 for a status conference, where a trial date may be set.
Following the hearing, Kirk’s family viewed Graf’s decision as a significant step toward justice.
