Pro Football Hall of Famer Emmitt Smith faces allegations of defrauding a Native American investor of $2.5 million. The lawsuit was filed in Delaware and involves Kituwah LLC, which represents the investment and economic development segment of the Band of Cherokee Indians. According to Front Office Sports, the company was persuaded to invest in a solar project by Smith, his business partner David Mosley, and their real estate company, 413 Solutions, Inc.
Kituwah claims no payment has been made on the loan, which is now more than two years overdue. The lawsuit states the funds were used to repay another company that had previously invested in the project.
The venture, named Project Exodus solar farm, promised Kituwah a partnership and suggested funding from the U.S. Department of Energy.
“Kituwah poured substantial time, efforts, and resources in the purported joint venture,” the lawsuit reads.
Kituwah is demanding at least $2.5 million in damages, including interest and other expenses incurred during efforts to get its money back. The company likens the situation to a Ponzi scheme, alleging misleading projections and data led them to make the loan. The loan was meant to be repaid within months.
The investigation revealed funds were directed to Wilson Holdings, a company associated with Smith and other defendants in separate investments.
Smith, known as the NFL’s all-time leading rusher with 18,355 yards, spent most of his career with the Dallas Cowboys, securing three Super Bowl victories. He concluded his playing days with the Arizona Cardinals. Smith continues to hold records for rushing touchdowns (164) and rushing first downs (1,028).
