California Insurance Commissioner Race: A Crucial Election

2 hours ago 0

The race for California’s insurance commissioner could be the most impactful election of the season, despite its low profile. Democratic candidates Ben Allen and Jane Kim are competing for this significant role, which oversees the California Department of Insurance, the largest state consumer protection agency in the U.S.

The insurance commissioner, a position currently filled by the termed-out Ricardo Lara, leads a department of 1,400 employees responsible for regulating 1,600 insurance companies and over 510,000 agents, brokers, and related entities. Their oversight covers a wide range of insurance types—home, car, health, life, pet, workers’ compensation, ride-hailing, and Medicare supplement insurance.

“It’s the most important elected job or position in California behind only the governor and attorney general,” said Dave Jones.

Jones, who served as insurance commissioner from 2011 to 2019, highlights the pervasive role of the office in everyday life. The position affects daily concerns, such as health insurance, and steps in for significant events, like life insurance and workers’ compensation.

Regulatory Authority and Challenges

The California insurance commissioner can regulate property insurance rates for homes and small businesses. Insurers must file and justify their rates to the commissioner, a requirement not common in many other states. This regulatory framework relates to broader affordability issues linked to rising insurance rates, which can impact renters as property owners transfer increased costs to them.

Jones points to a growing issue with the rate of coverage denials and the reliance on the California FAIR Plan, which serves as a last-resort option for fire insurance. This plan, although more expensive than traditional coverage, is increasingly necessary as traditional coverage becomes harder to obtain. In 2019, approximately 190,000 Californians were part of it. By September of this year, about 686,000 residents were enrolled.

Surplus Line Market

Another alternative for coverage is the Surplus Line Market, which operates outside the commissioner’s regulation. This market covers high-risk entities, like unique businesses and properties, and saw 300,000 homeowners signing up by 2025. Policies in this market are expensive compared to traditional options.

The challenge of keeping insurance companies in the state remains significant. However, except in cases of wildfire, where a one-year moratorium on cancellations can be issued, the commissioner’s powers are limited in preventing non-renewals and cancellations.

Additional News Highlights

Elsewhere in the political arena, Los Angeles Mayor Karen Bass and Councilmember Nithya Raman are intensively campaigning as the election nears. Their race, along with California’s susceptibility to El Niño effects and President Trump’s declining approval ratings, are catching public attention.
