Debate Over Deportation Betting Market
A Democratic congressman criticized a prediction market allowing users to bet on immigrant deportations by the Trump administration. This market is offered by Kalshi, which proposes outcomes based on various deportation totals. It currently shows a 96 percent likelihood of over 400,000 removals.
Massachusetts Representative Seth Moulton condemned the market. In a post, he compared it to previous betting options on military operations, urging Kalshi to cease such activities. Moulton noted his efforts to prevent staff from trading on prediction markets, emphasizing that human lives shouldn’t be treated as gambling stakes.
The Department of Homeland Security (DHS), however, signaled support for the market. In a response, they hinted that Trump’s deportation numbers might exceed current expectations. This comment indicated confidence in achieving high deportation figures.
Moulton’s Immigration Stance
Moulton’s criticism aligns with his recent immigration advocacy. He has often spoken against Trump-era enforcement policies. In June, he pushed for legislation aimed at enhancing judicial review for Temporary Protected Status decisions. This move intended to protect many immigrants from expulsion without proper court oversight.
His office also provides guidance for those facing Immigration and Customs Enforcement (ICE) actions. This includes resources on legal rights and representation. While not completely opposing enforcement, Moulton stresses the necessity of ensuring due-process protections in deportation policies.
Legality of Prediction Markets
The legality of prediction markets like Kalshi is debated. Kalshi operates under federal regulation as a registered exchange with the Commodity Futures Trading Commission (CFTC). It argues that its contracts are financial products covered by federal commodities law.
The Commodity Exchange Act permits regulated exchanges to list event contracts but subjects certain topics to greater scrutiny. This includes markets related to war, terrorism, and assassination. The CFTC has the authority to review and possibly ban contracts deemed against public interest.
Determining the status of prediction markets on elections, public health, and government actions remains unresolved. Some Democratic lawmakers have advocated for more stringent regulation to limit contracts involving sensitive government actions.
Deportation Figures Under Trump
Since Trump’s return to office, deportation enforcement has increased, although figures fall short of the administration’s goal of 1 million annual deportations. ICE removal data indicate the deportation of approximately 400,000 people in the first year, a rise from previous years but below the targeted pace.
Measuring these efforts is complex. Deportation statistics for Fiscal Year 2025 include months before Trump’s administration, impacting the annual totals. Moreover, Customs and Border Protection (CBP) and the Border Patrol also handle removals, further complicating the data.
MPI analyst Ariel G. Ruiz Soto noted an increase in ICE removals since Trump took office, linking it to a focus on interior enforcement. The data spurs debate on whether the government meets Trump’s mass deportation promises, making it a crucial measure of immigration policy. The betting market controversy arises from this context, with critics arguing that it commercializes a politically charged issue.
