Fatal Trench Collapse in Ohio Raises Safety Concerns

In Ohio, a tragic accident occurred when a trench collapsed during a job, killing one worker and injuring two others. The incident happened on December 5, involving workers replacing a storm drain near Milford. Federal investigators reported that workers had warned of the trench’s dangerous depth but were instructed to enter it. The trench, approximately 8 feet deep, lacked protection against cave-ins, violating federal safety rules for trenches deeper than 5 feet.

Jose Alberto Barajas Martinez, 28, lost his life in this collapse. The company responsible, Whispering Creek LLC, faced five safety violation citations and was initially fined $231,714, later reduced to $49,000 as pending criminal charges are considered by Clermont County prosecutors.

A trench collapsed while three workers attempted to install piping near Milford, Ohio. One worker died and two others were seriously injured.

David Baumgardner, the owner of Whispering Creek, was present at the site and aware of the trench’s condition. He admitted to investigators that he had used cave-in protections for previous projects but omitted them in this case, claiming the depth wasn’t sufficient.

The investigation accuses Baumgardner of “conscious disregard” for safety regulations, demonstrating “plain indifference.” He mentioned that Barajas Martinez was his friend, and his death was deeply impactful. Baumgardner even claimed to have saved one worker himself.

The collapse occurred as the workers were fitting corrugated pipes in a residential area. Rescue teams arrived, finding one man fully buried and unconscious and the other two partially buried. Due to instability, firefighters couldn’t enter the trench immediately. They provided oxygen and heated blankets to the trapped men while equipment arrived to stabilize the site.

Rescuers took several hours to free the survivors, removing dirt bucket by bucket. Tragically, one man was pronounced dead at the scene. OSHA investigations revealed that necessary safety measures like ladders weren’t present before the collapse. The company was also criticized for inadequate worker training and not maintaining a safe distance for excavated materials from the trench’s edge.

One of the survivors, Jaime Barajas, father of the deceased worker, and the other survivor suffered severe injuries. They endured fractures and internal damage, with one eventually returning to work while the other remains in recovery.

Legal proceedings are underway, with authorities considering charges like reckless homicide and negligent assault. David Baumgardner anticipates felony charges, but no formal charges were made by August 14. The Clermont County Prosecutor’s Office is reviewing the case.
