Jay Clayton has been nominated by President Trump as the next director of national intelligence. Over the past 14 months, Clayton has served as the U.S. attorney in Manhattan and previously acted as the chairman of the Securities and Exchange Commission during Trump’s first term. His career spans both private law practice and government service.
Career Before U.S. Attorney
Before becoming the U.S. attorney, Clayton was a partner at Sullivan & Cromwell, a New York law firm. During his tenure as the chairman of the SEC, he adopted a pro-business stance but also launched some of the first enforcement actions involving crypto assets. Notable among these was an action against Elon Musk concerning his activities on Twitter, which Musk later acquired and renamed as X.
Significant Cases Under Clayton
The Manhattan U.S. attorney’s office, known for handling high-profile cases, has been involved in major international prosecutions under Clayton’s leadership. One prominent case is against Nicolás Maduro, the former president of Venezuela. Captured by U.S. military forces in January, Maduro faces charges related to a cocaine importation conspiracy. Maduro has entered a not guilty plea.
Recently, the office charged a commander of an Iran-backed militia for planning attacks on Jewish sites in New York City and for orchestrating related attacks in Europe. This case is part of Iran’s retaliation against the U.S. and Israel.
The Southern District is also managing the federal case against Luigi Mangione, accused of assassinating UnitedHealthcare’s chief executive in 2024. Clayton is recused from this case, which is being led by his deputy.
