A judge in Sullivan County recently listened to oral arguments on whether New York Attorney General Letitia James should continue overseeing a criminal investigation into claims of a gang rape at Cornell University. The session concluded without Judge James Farrell making a decision.
The legal matter arose after defense attorney Andrew Miltenberg, representing Gillio Lopes, one of the accused, filed a challenge. Lopes and six other former Chi Phi fraternity members face allegations of drugging and raping a Cornell student in October 2024.
Questioning James’ Neutrality
Miltenberg argued that comments made by James prior to her official appointment compromised her impartiality. Public remarks, including a supportive message for the alleged victim, were cited as evidence.
“What this young woman has been forced to endure is horrific and unacceptable,” James stated online. “To her, and to all survivors: you’re not alone. We stand with you.”
In response, the Attorney General’s office described the challenge as unfounded and confirmed their commitment to a fact-based investigation.
Assistant Attorney General’s Defense
Assistant Attorney General Kaitlin Vigars defended the appointment, stating that personal opinions shared publicly do not meet the criteria necessary for removal. Actual evidence of prejudice, not assumed bias, is needed for disqualification.
Judge Farrell questioned Vigars regarding the sequence of events leading to James’ appointment and the potential influence of her prior statements. The possibility of conflicting legal outcomes across various jurisdictions was also expressed as a concern.
State’s Procedural Changes
Governor Kathy Hochul, who had appointed James after bypassing the local district attorney, noted procedural changes. All sexual assault cases at Cornell will now be referred to the New York State Police.
Hochul emphasized, “Every student deserves to feel safe on their campus… Survivors should be able to trust the institutions responsible for protecting them.”
With the judge yet to issue a ruling, the decision on whether James will remain in her role is expected soon.
