On May 19, as tumultuous weather swept through the area, Foyle was struck by this fallen tree while dining outdoors. Family members are now pursuing legal action, naming Green Mesquite BBQ and nearby property owners as defendants.

The complaint highlights unaddressed decay and disease in the tree, referred to ominously as the ‘Widow Maker,’ located at 1410 Barton Springs Rd. This defective tree extended perilously over Green Mesquite’s outdoor patio, leading to Foyle’s untimely death by blunt trauma, confirmed by the Travis County Deputy Medical Examiner.

Legal allegations claim negligence for not inspecting or maintaining the tree, exacerbating its hazardous condition. These assertions counter Green Mesquite’s defense, suggesting lightning caused the tree’s fall, which the Foyle family’s legal representatives contest. The family seeks justice and reparations, targeting gross negligence from the restaurant and adjacent property owners with a demand for at least $1,000,000 in damages.
