Homicide Convictions of Colorado Paramedics Overturned

In a significant legal development, a Colorado court has overturned the homicide convictions of two paramedics involved in the 2019 ketamine overdose death of Elijah McClain. The court’s decision was delivered on Thursday and impacts Jeremy Cooper and Peter Cichuniec, paramedics with Aurora Fire Rescue, calling for new trials.

McClain, a Black massage therapist, was restrained by police responding to a suspicious person report as he walked home from a convenience store. The 2023 jury had found Cooper and Cichuniec guilty of criminally negligent homicide after a prolonged trial.

Cooper’s sentencing involved 14 months in jail, combined with work release and probation, avoiding prison. Cichuniec faced a harsher penalty due to an additional felony assault charge, which the appeals court upheld.

The appeal highlighted improper jury instructions concerning the criminally negligent homicide charges, leading to the decision for retrials. The case continues to be a focal point in ongoing discussions about law enforcement and medical response accountability.
