Legal Group’s Guide Encourages Cooperation with ICE
A conservative legal group, America First Legal (AFL), is advising New York City police officers that they can share immigration status information with U.S. Immigration and Customs Enforcement (ICE) directly, even if local policies suggest otherwise. A newly released guide, titled “Law Enforcement Officer Immigration Cooperation Guide,” confirms this stance.
The guide argues that Section 1373 of federal law prevents state and local governments from barring officers from sharing information with federal authorities like ICE. AFL, a nonprofit organization, aims to defend the rights of Americans and has released this guide as Homan plans an immigration enforcement operation in New York City.
ICE Surge in Response to Sanctuary Policies
In response to Mayor Mamdani’s executive order reinforcing sanctuary-city policies, Homan announced plans to deploy more ICE agents in New York City. The guide repeatedly references Section 1373, emphasizing that officers have the legal right to communicate immigration status information to federal agencies.
Mamdani and Trump Administration Clash
Mayor Mamdani and the Trump administration are at odds over immigration enforcement. Mamdani has issued Executive Order 13, directing the NYPD to update policies for interacting with federal immigration authorities. The order criticizes non-local agencies for tactics that create fear and jeopardize public safety.
However, America First Legal argues that federal law overrides local policies, making it possible for officers to share information with ICE. AFL warns that sanctuary policies might pose legal risks for those enforcing them, suggesting potential federal charges or civil lawsuits under RICO law.
Legal Representation for Officers
AFL invites officers to seek legal representation if they feel threatened or retaliated against for cooperating with ICE. AFL Senior Counsel James Rogers states that politicians do not have the authority to restrict officers who are working to ensure community safety.
America First Legal President Gene Hamilton underscores that officers should not have to choose between federal law and policies driven by sanctuary ideologies. New York City officials have not commented on the issue.
