Trump Administration Tightens H-1B Visa Regulations

1 day ago 0

The Trump administration initiated measures against the misuse of the H-1B visa program. Labor Secretary Keith Sonderling discussed the issue, highlighting how some companies exploit the system, disadvantaging U.S. workers. He stressed that major tech firms should prioritize domestic employment and avoid abusing H-1B visas.

In related news, Instacart, a well-known grocery delivery service, settled a major case with the Department of Justice (DOJ). Accusations claimed the company discriminated against American workers based on their origin. The DOJ and Instacart concluded a $5 million settlement, addressing alleged violations of the Immigration and Nationality Act and Title VII of the Civil Rights Act of 1964.

The controversy centered on submissions for the Permanent Labor Certification (PERM) process. Instacart required American applicants to mail physical applications, a departure from its standard electronic procedures. This practice occurred between December 2023 and February 2026.

Assistant Attorney General Harmeet K. Dhillon highlighted that this marks the 15th settlement to protect U.S. workers since her tenure began. The DOJ is committed to ensuring a fair job market, holding accountable companies favoring temporary visa applicants over American candidates.

The Equal Employment Opportunity Commission (EEOC) collaborated on the settlement. Instacart will establish a $4 million fund for affected applicants and pay $1 million in civil penalties. The PERM program, while allowing visa workers a path to permanent residency, mandates efforts to hire U.S. workers first.

Companies cannot impose additional barriers or discriminate against American workers. Violations include unfair job ads and restrictive hiring processes. Since Trump’s second term began in January 2025, the administration has enforced these rules to protect American workers. The EEOC’s initiative, named “Project Firewall,” aims to combat employment discrimination.

EEOC Chair Andrea Lucas stated that erecting unlawful barriers against U.S. workers will be met with decisive action. The commission is dedicated to ensuring equal employment opportunities regardless of national origin.

An Instacart spokesperson emphasized the company’s commitment to hiring American workers. Instacart asserts its compliance with laws while expressing satisfaction in resolving the matter to focus on serving its clients.
