Texas Woman Sues Torchy’s Tacos Over Cow Tooth Discovery

1 hour ago 0

A Texas woman, Nohemi Castillo, has filed a lawsuit against Torchy’s Tacos after allegedly discovering a cow tooth in her meal. The incident occurred on June 9 at the chain’s South Congress Avenue location in Austin. Castillo claims she almost swallowed the tooth while eating takeout tacos.

According to a lawsuit obtained by Fox News Digital, the unusual ingredient was confirmed by Torchy’s Tacos. The company stated, “Upon receiving the guest complaint, we conducted a thorough review and identified the item as a cow tooth.” The restaurant explained that such occurrences are rare but can happen during the meat processing. The beef cheek used in their barbacoa comes from a natural supplier, and steps have been taken to prevent similar incidents.

Castillo’s attorney, Scott Vasquez, revealed that Torchy’s Tacos acknowledged the discovery following media attention in October, months after the initial event. Photographs show the tooth alongside a tape measure, underscoring its size.

A witness recounted the moment Castillo found the object in her tacos, saying, “As we were eating, I heard an ‘awww!’ When I turned to Nohemi, I saw her pulling something out of her mouth.” Initially thought to be a bone, Castillo later realized it was a tooth.

Disgusted and sickened, Castillo sought medical attention that evening. The lawsuit claims she sustained physical pain, mental anguish, and incurred medical expenses. She accuses Torchy’s of failing to properly prepare, inspect, and distribute the food. The complaint also alleges breaches of implied warranties and violations of food safety requirements.

Castillo seeks monetary relief of $250,000 or less, as determined by a jury. Her attorney has mentioned other similar incidents reported by individuals, though unverified.

Torchy’s Tacos asserts that it handled the complaint with seriousness, stating, “We are aware of the situation and take all concerns about our food seriously.” The company did not immediately comment further on the matter.
