The Ongoing Battle

The clash between comedians, broadcasters, and federal regulators continues, focusing on First Amendment issues in the U.S. The controversy centers around the actions taken by Brendan Carr, who was appointed as chair of the Federal Communications Commission (FCC) by President Donald Trump.

September 17 marks a year since Carr urged media companies to drop Jimmy Kimmel’s show after the comedian made remarks about Trump and the ‘MAGA gang’ during a segment about conservative activist Charlie Kirk’s death. Kimmel humorously compared Trump’s reaction to the way a child might mourn a goldfish, leading Carr to describe the comments as ‘some of the sickest conduct possible.’ Carr warned of possible suspension, emphasizing the seriousness of the issue for ABC’s parent company, Disney.

ABC briefly suspended Kimmel’s show after several affiliates pre-empted it indefinitely. Although the suspension lasted just six days, during which Disney+ cancellations reportedly surged, it raised concerns about free speech and censorship under Trump’s administration. The FCC and Disney did not comment when contacted by Newsweek.

Concerns Over Regulation

Bob Corn-Revere, chief counsel at the Foundation for Individual Rights and Expression (FIRE), highlighted the long-standing nature of these disputes, referencing Trump’s earlier threats to revoke network licenses. The tension has grown, as Carr seems ‘fully committed to doing the president’s bidding,’ raising concerns among broadcasters.

Recently, Kimmel revealed that an interview with Democrat state Representative James Talarico would be aired on YouTube rather than television due to FCC pressure and new rules enforcement. The FCC mandated that TV talk shows must provide equal time to all candidates in a political contest, impacting Kimmel’s editorial decisions.

The White House dismissed Kimmel’s claims as ‘play acting,’ denying any threats regarding the interview. However, Christopher Terry from the University of Minnesota pointed out that regulatory pressure forces broadcasters to alter editorial choices, violating the Communications Act and First Amendment.

Courtroom Battle

Anna Gomez, the Democratic commissioner at the FCC, accused the agency of intimidation and claimed it lacks authority to threaten broadcast licenses over editorial decisions. Disney’s ABC has been actively fighting this coercion, filing a lawsuit against the FCC.

In April, Carr initiated an early license review for eight ABC stations over alleged discrimination at Disney. He stated this review is unrelated to Kimmel or past conflicts, yet Disney perceived it as retaliation.

In its lawsuit, Disney argues that government censorship is un-American, asserting that the FCC’s actions represent a retaliatory campaign against ABC’s programming decisions. Carr’s remark about doing things ‘the hard way’ is cited as evidence of coercion.

Episodes like these bolster Disney’s court case. Corn-Revere predicts that if the court favors ABC, Carr’s strategy could backfire, undermining attempts to pressure broadcasters.

Disney’s Fight Against FCC Pressure

Disney, having previously succumbed to pressure regarding off-color remarks from one of its biggest names, now uses the same episode to bolster its legal arguments. Despite ongoing regulatory pressures, Disney’s actions continue to highlight FCC constraints on editorial choices.

By bringing the issue into public view, the FCC might inadvertently strengthen Disney’s position in demonstrating a long-running campaign of regulatory pressure. Anna Gomez noted that episodes like these merely strengthen Disney’s case.

Corn-Revere added that this recent episode offers further evidence for ABC’s litigation against the FCC, suggesting that if the court sides with the network, Carr’s efforts may be thwarted.

Returning from a summer break, Kimmel addressed viewers on his 4,000th show. He alluded to attempts by the FCC to curtail his show’s longevity, declaring its continued presence despite regulatory challenges.
