Ethical Concerns Emerge as Prediction Markets Influence North Carolina Congressional Race

North Carolina Republican Laurie Buckhout, vying to overturn a Democratic-held congressional district, faced disciplinary measures after engaging in trading activities on a platform linked to her own electoral race. Kalshi imposed a fine and suspension upon Buckhout for purchasing contracts concerning her candidacy in prediction markets.

Prediction markets have become increasingly popular in recent years, where participants buy contracts related to events like elections. Traders invest in contracts based on anticipated outcomes, sparking ethical concerns. Kalshi and Polymarket are two notable platforms where politicians have previously engaged in insider trading.

On Monday, Kalshi issued a notice of settlement regarding disciplinary action against Buckhout. She breached Rule 5.17(z), which bars any ‘decision maker’ or those with ‘influence’ over an event from trading on it.

Buckhout, an Army veteran running for Congress in North Carolina’s 1st District, acquired contracts worth less than $1,000 related to her campaign. She is now required to pay a fine of $2,589.96 and is suspended from Kalshi for three years.

Kalshi’s report noted Buckhout’s declaration of candidacy and subsequent market inclusion for contracts on the North Carolina Congressional election. As a candidate, she directly influenced the event’s outcome. Buckhout cooperated with the investigation and agreed to the terms, including paying the financial penalty and accepting trading restrictions.

In a statement to Newsweek, Buckhout acknowledged her error, stating, “I bet on myself. It was a dumb mistake, and as soon as I learned there was an issue, I worked to make it right. Safe to say my career as a Kalshi trader was short-lived.”

Democratic Congressional Campaign Committee spokesperson Madison Andrus criticized Buckhout, asserting, “Looks like Laurie Buckhout is getting a jump-start on her insider trading aspirations. If Buckhout can’t be trusted to follow the most basic prediction market rules, there is no chance she can be trusted as an ethical representative for North Carolina families.”

The district Buckhout is targeting in northeastern North Carolina is currently held by Democratic Representative Don Davis. It was redrawn to favor Republicans, showing support for President Donald Trump by nearly 12 points. Should Davis maintain his seat, the district could become one of the more conservative areas controlled by a Democrat post-midterms.

Democrats consider the race competitive due to Davis’s moderate stance, appealing to centrist Republicans. Despite previous Republican support, Davis secured the district against Buckhout. The broader national scene appears to favor Democrats, attributed to diminishing approval ratings for Trump and public dissatisfaction with economic issues and international conflicts.

Independent polling remains sparse, but internal surveys suggest a tight competition. A GQR poll showed Davis leading Buckhout by four points, while a co/efficient poll, backed by the NRCC, indicated a tie between Buckhout and Davis, each earning 41% support. The generic Republican ballot favored them by four points, according to this poll.

Forecasters predict a competitive race. The Cook Political Report rates it as Leans Republican, whereas Sabato’s Crystal Ball considers it a toss-up following redistricting.

Other politicians have faced similar repercussions for engaging in insider trading within prediction markets. Earlier instances include the suspension of Democrat Matt Klein, who’s contesting Minnesota’s 2nd Congressional District, Virginia Senate candidate Mark Moran, and Ezekiel Enriquez from Texas’s 21st Congressional District.

Additionally, former New York Representative George Santos faced a permanent ban and substantial financial penalty from Kalshi due to a CFTC-related case tied to trades on his attendance at Trump’s State of the Union address. Santos addressed the ban in a social media post directed at Kalshi.
