Federal Judge Rejects Trump Administration’s Election Lawsuit in Alaska

1 hour ago 0

A federal judge in Alaska has dismissed the Trump administration’s lawsuit attempting to block the certification of the state’s Senate election results. The lawsuit sought intervention if Republican incumbent Sen. Dan Sullivan lost in the recent midterm elections.

Judge Sharon L. Gleason issued a 20-page order stating the Justice Department lacked proper legal standing. The lawsuit aimed to halt certification due to another candidate, Daniel J. Sullivan, running with the same name and party affiliation, allegedly confusing voters.

The Justice Department argued this confusion potentially diverted votes from Sen. Sullivan, benefiting Democrat Mary Peltola. Judge Gleason highlighted the inability of the United States to establish a valid plan to distinguish ballots cast for Daniel J. Sullivan while maintaining voter confidentiality.

“More fundamentally, the United States provides no workable plan as to how it proposes to segregate ballots cast for Daniel J. Sullivan on Election Day,” Judge Gleason wrote, noting the insufficiency of the Justice Department’s argument.

The Justice Department amended the lawsuit to include allegations from The New York Times about efforts to influence the election. The amended suit claimed Peltola’s campaign was involved in recruiting Daniel J. Sullivan to attract votes away from Sen. Sullivan.

Peltola denied involvement, stating she had no interest in tricking voters. Sen. Sullivan expressed concern about losing votes due to the confusion, questioning Peltola’s knowledge of her aides’ activities.

Besides the civil case, the Justice Department is conducting a criminal investigation into the alleged addition of Daniel J. Sullivan to the ballot. Subpoenas have been issued targeting several Democratic officials, though no charges have been filed.
