A federal judge in Minnesota has blocked the Justice Department’s subpoenas targeting state and local officials. This decision, detailed in a document unsealed on Monday, describes the Trump administration’s actions as politically motivated, using the grand jury process inappropriately.
Chief Judge Patrick J. Schiltz criticized the subpoenas. He stated they aimed to pressure Minnesota officials into aiding federal immigration enforcement and penalize them for non-compliance. Schiltz, appointed by President George W. Bush, had previously expressed concerns about the Trump administration’s Operation Metro Surge. This operation resulted in numerous arrests and shootings in Minnesota, with many detainees held without hearings.
During the operation, Judge Schiltz called on the leader of Immigration and Customs Enforcement to justify the detention practices. However, he later withdrew this request. A Department of Homeland Security spokesperson dismissed one of Judge Schiltz’s previous rulings as a ‘diatribe from an activist judge.’ The Justice Department and Homeland Security representatives did not comment on the latest decision to block the subpoenas.
In January, as part of Operation Metro Surge, the Justice Department targeted several Minnesota Democrats critical of the Trump administration’s immigration policies. The subpoenas demanded records related to these offices’ immigration enforcement policies. Judge Schiltz argued that these subpoenas pursued legal, constitutionally protected activities.
Officials such as Governor Tim Walz, Attorney General Keith Ellison, and Minneapolis Mayor Jacob Frey received subpoenas. Many expressed approval of the judge’s ruling. Mayor Frey stated, ‘No one should be targeted for questioning those in power. No community should be expected to accept harmful policies without objection. And no administration should use the tools of law enforcement to silence dissent.’
