President Donald Trump’s lawsuit against the IRS was deemed filed for an “improper purpose,” as stated by U.S. District Judge Kathleen Williams on Monday. In a critical decision, the judge referred one of Trump’s lawyers for disciplinary action, labeling the $10 billion complaint as self-serving.
Judge Williams accused Trump of manipulating the court system by suing a federal agency under his control. This action circumvented the requirement for adverse interests between suing parties. The legal maneuver aimed for a settlement in which Trump received immunity from tax audits and established a fund for compensating his allies who claimed unjust persecution.
The ruling’s practical effects might be limited due to public statements about abandoning the $1.776 billion Anti-Weaponization Fund. However, the judge’s decision serves as a harsh critique of the Trump administration. The decision resurfaces a politically sensitive issue for Acting Attorney General Todd Blanche, as he faces the Senate Judiciary Committee for his confirmation hearing on Wednesday.
“The nature of the suit itself and the conduct of the Parties and counsel from its filing make plain that this was an attempt to use the Court to provide some legitimacy to an agreement to confer immunity to people and entities affiliated with the President and to earmark billions of dollars from American taxpayers to redress grievances not defined in the law,” Judge Williams stated. She further emphasized that all parties and lawyers in civil suits must adhere to constitutional rules.
The judge highlighted Blanche’s congressional testimony from early June, where he disclosed the “anti-weaponization” fund’s halt amidst bipartisan opposition. Blanche’s apparent ability to represent both plaintiffs and defendants, sign a “settlement” document, and later nullify part of that agreement revealed that only one party’s interests were represented throughout the case.
