Senate Pushes for Expanded Tariff Powers for President Trump

The Trump administration recently refunded billions of dollars in tariffs to American companies. Now, the Senate is contemplating granting President Donald Trump more precise tariff authority worldwide. Senator Rick Scott from Florida is spearheading an effort to secure congressional approval for tariffs, specifically targeting countries with persistent trade deficits with the U.S.

According to Scott, previous generations built America into an economic superpower, and it is essential to preserve this legacy for the future. He emphasizes the need to prevent other countries from exploiting U.S. markets.

The Trade Deficit Elimination Act proposed by Scott aims to establish a congressional framework to authorize tariffs against nations where trade deficits threaten U.S. national security, foreign policy, and economic interests. This legislation calls for an annual watch list of countries with pronounced trade deficits, compiled and identified by U.S. Trade Representative Jamieson Greer. These nations would be classified as having “trade deficit economies.”

On this basis, Scott’s bill empowers Trump to adjust tariffs on imports from these countries to eliminate bilateral goods trade deficits. The process would require consulting with Congress, especially the House Ways and Means and Senate Finance committees; however, it doesn’t demand congressional approval for imposing duties on listed countries. Some products essential to U.S. supply chains, national security, or lacking alternative sources are exempted from these tariffs.

Scott argues that foreign trading partners have exploited access to American markets while sidelining U.S. products in their domestic markets. He views President Trump’s actions as a measure to rejuvenate American prosperity.

The announcement of Scott’s proposal came soon after the Trump administration’s refund of $100 billion in tariff revenue, which was previously collected under widespread duties. Trump had initially imposed these tariffs using the International Emergency Economic Powers Act (IEEPA), but the Supreme Court subsequently ruled that he lacked the authority. Scott’s bill introduces a new power with strong congressional backing, under Article 1, Sec. 3, targeting international commerce.

Senators Kevin Cramer from North Dakota and Tim Sheehy from Montana are co-sponsoring the bill, separate from the IEEPA powers. Cramer highlighted the fairness of trade and supports holding trading partners accountable. He noted that this bill provides President Trump and Ambassador Greer the necessary tools to manage trade deficits, safeguard critical supply chains, and negotiate better trade agreements benefiting American farmers, ranchers, manufacturers, and workers.
