Supreme Court Ruling: States Can Limit Transgender Athletes in Girls’ Sports

President Donald Trump hailed the Supreme Court’s recent ruling as a significant triumph. The decision favored West Virginia and Idaho by a 6-3 vote, denying transgender athletes the right to participate in girls’ sports. Trump expressed his approval through a post on Truth Social, celebrating the decision as a victory that addresses what he called a ‘ridiculous situation.’

The Supreme Court has left the decision regarding transgender athletes in women’s sports to the states. Justice Sonia Sotomayor, joined by Justices Kagan and Jackson, submitted opinions partially concurring and dissenting with the ruling. The court underscored the states’ authority to maintain women’s and girls’ sports for biological females, aligning with Title IX and the Equal Protection Clause.

President Trump signed an executive order titled ‘No Men in Women’s Sports’ on February 5, 2025. This order initiated further restrictions on transgender athletes. States now have the legal authority to protect women’s sports without the fear of lawsuits. However, there remain 23 states without laws of this nature, and some support transgender athletes in girls’ sports.

Following his executive order, Trump threatened to block federal funds to non-compliant states. This led to a conflict with Maine Governor Janet Mills. Though Trump froze funds to Maine, a federal judge later mandated the release of those funds, highlighting ongoing legal tensions.

Alliance Defending Freedom (ADF) represented the states in court, while the American Civil Liberties Union (ACLU) and Cooley Legal defended the transgender athletes. Linda McMahon, Education Secretary, stated that today’s verdict affirms the protection of women’s sports against discrimination based on sex.

Supporters of this decision argue that it preserves female sports’ integrity. Approximately 80% of Americans oppose biological males competing in women’s sports according to surveys.
