Trump’s Struggles with Mail-in Voting Regulations

President Donald Trump is striving to implement stricter mail-in voting regulations. The Supreme Court lifted an injunction against parts of Trump’s March executive order. However, this victory is limited as another injunction concerning the legality of Trump’s mail-ballot provisions continues to be in place.

Supreme Court Decision

The Supreme Court ruled that Democratic states challenged Trump’s executive order prematurely. Despite lifting that specific injunction, the nationwide injunction prevents the USPS from applying Trump’s mail-ballot provisions for the November 3 elections.

North Carolina is set to issue ballots to absentee voters on September 4. While the administration may win the legal battle, the midterms might proceed without the new regulations.

Trump’s Executive Order

Trump’s order involves several changes to federal election procedures. It requires the Department of Homeland Security and Social Security Administration to provide lists of adult citizens to state election officials. Election officials would have to submit this data to USPS before accepting mail-in ballots.

The order also mandates investigations into fraudulent voting practices and calls for mail-ballot envelopes with tracking barcodes to reduce voter fraud. Within these provisions, Judge Indira Talwani’s injunction prevents USPS from rejecting existing mail ballots.

As the election approaches, changes cannot be easily implemented without fulfilling new requirements for envelopes, barcodes, and data submissions.

Consequences of Lifting the Injunction

Even if the injunction is lifted soon, adjustments to federal ballot mailings can be applied. This rule would allow USPS to reject mailings that fail to meet new standards prior to resubmission.

Mail voting accounted for nearly one-third of the turnout in the 2024 presidential election. Almost 48 million mail ballots were returned, with 47.6 million counted.

If Trump’s regulations persist legally, they will apply to all future federal elections, except for primaries and ballots for military and overseas voters.

Impact on Election Integrity

If Trump’s regulations are not applied quickly enough for the midterms, public confidence in election integrity remains at risk. Only 55% of Americans are confident in a fair and accurate midterm election, a decrease from prior years.

The administration states that the USPS rules aim to lower fraud and secure trust in federal elections. Trump maintains that mail voting is prone to fraud, reinforced following his defeat to Joe Biden.

Should GOP candidates underperform in the midterms, the injunction against Trump’s regulations may serve as a political weapon for Trump. The Justice Department found no fraud sufficient to alter the 2020 presidential election outcome, yet Trump continues to blame mail voting for election losses.
