Chilling surveillance footage from September 15 showcases a UC Berkeley student’s alarming encounter with a man suspected to be homeless, who pursued her into a locked gate of her apartment complex. The video, taken in Berkeley, California, captures the student entering the secured building at around 8 p.m., shortly before the man scales the barrier, allegedly following her inside. Initially rumored to be wielding a knife, the object in the man’s possession was later identified by Berkeley police as likely a barbecue lighter. Despite there being no direct physical confrontation with the student, the incident has sparked considerable concern.

The student, referred to simply as Eden for her safety, recounted her experience to ABC7. She was walking her dog along Berkeley Way when approached by the man, who made unsettling gestures and began chasing her. She managed to enter her apartment complex and take refuge in an elevator before he could see her destination. Eden’s quick thinking allowed her to shut the gate behind her just as the man arrived and began climbing over it.

The Berkeley Police Department received Eden’s urgent call at approximately 8:04 p.m. However, patrol officers were engaged with other critical emergencies, including a domestic violence incident and a missing person report. As a result, the response was delayed, and officers were unable to find the suspect when they arrived about an hour later.

The following evening, at around 9:24 p.m., the department received another report indicating that the same man was lying on a sidewalk near Berkeley Way and Walnut Street. Officers who responded to the scene detained and identified him as the individual involved in the previous night’s alleged trespassing. Nonetheless, he was not arrested, as California law typically bars police from making warrantless arrests for misdemeanors not observed directly by officers.

Berkeley police have forwarded the case to the Alameda County District Attorney’s Office for examination to decide whether charges should be pursued. The District Attorney’s Office has confirmed its review of the case, yet no charges had been filed as of the report’s update. The situation has led Eden to express her dismay over the legal constraints that permit a suspect to evade arrest after such a distressing incident. She has advocated for stronger laws and enhanced protections for community members.
