Bipartisan Agreement Announced

On Wednesday, Democratic and Republican senators announced a long-negotiated deal on permitting reform. This deal aims to expedite the construction of energy and infrastructure projects across the nation while managing costs from data centers.

Sens. Shelley Moore Capito (R-W.Va.), Mike Lee (R-Utah), Sheldon Whitehouse (D-R.I.), and Martin Heinrich (D-N.M.) revealed the agreement, which they plan to vote on during the lame-duck session post-election. Heinrich noted that the proposal requires data centers to cover the electricity costs they add to the grid, preventing these expenses from being passed to consumers.

Comprehensive Reforms to Environmental Review

Senator Capito mentioned that the proposal includes extensive reforms to the environmental review and permitting processes under the National Environmental Policy Act. The review process has faced criticism from various industries for being time-consuming, though proponents believe it is crucial for protecting communities and the environment.

A significant part of these negotiations involved the Trump administration’s resistance to renewable energy projects. Whitehouse highlighted that the issue of resuming regular order for wind and solar projects from the Trump era remains unresolved. However, he acknowledged that a reasonable opening proposal had been presented by the former administration.
