Since the overturning of Roe v. Wade, abortion remains largely accessible, partly due to abortion pills. The FDA has maintained a Biden-era policy allowing mifepristone to be distributed by mail.
However, a lawsuit by Louisiana has caused a temporary restrictions. These restrictions affect abortion providers’ ability to prescribe mifepristone via telemedicine and mail. In response to emergency appeals from two manufacturers, the Supreme Court has twice intervened, eventually restoring mail and telemedicine options indefinitely while lower courts continue proceedings.
Despite this legal uncertainty, President Trump has not commented. His administration’s Justice Department opted not to file a brief to defend the FDA, an unusual move.
Samuel Bagenstos, former general counsel for the Department of Health and Human Services, remarked on the administration’s silence, calling it shocking. He believes it underscores the difficult political position Trump faces regarding this issue.
