Dismissal of Federal Prosecutor Sparks Legal Battle Against Justice Department

A U.S. federal prosecutor, Sunita Doddamani, is suing the Justice Department, claiming her dismissal was politically driven. She alleges her firing related to her role in prosecuting anti-abortion activists. The lawsuit contends the termination breached the Civil Service Reform Act, the Administrative Procedure Act, and constitutional amendments. Doddamani, who served in the Eastern District of Michigan, was fired on April 13 without notice or reason, according to her legal filing.

The lawsuit suggests Doddamani’s dismissal stemmed from prosecuting eight activists under the Freedom of Access to Clinic Entrances Act (FACE Act). This law, established to prevent intentional interference with reproductive health services, has been contentious. At least two other prosecutors involved in similar cases were also terminated that day. The Justice Department declared it had dismissed employees for misusing the FACE Act, although it declined further comment.

The legal complaint identifies seven defendants, including Attorney General Todd Blanche and the Justice Department. It seeks a ruling affirming that Doddamani’s rights were violated, reinstatement with backpay, and additional relief. The lawsuit criticizes the Trump administration, alleging unlawful terminations were used for political objectives. It claims the Justice Department under Trump minimized enforcing the FACE Act, reserving action for severe cases.

The FACE Act, dating back to the 1990s, aimed to counteract violence against abortion providers. Nonetheless, opponents argue it restricts free speech of abortion critics. During Trump’s second term, the Justice Department limited enforcement of the FACE Act, focusing only on grave incidents, and he pardoned individuals convicted under it. Doddamani argues her firing has caused financial and reputational harm, seeking both justice and compensation.
