Disney and ABC Clash with FCC Over License Renewal

59 minutes ago 0

Disney and ABC have accused the Federal Communications Commission (FCC) of exerting undue pressure during the license renewal process. This follows Disney’s lawsuit against the FCC in August, claiming retaliation linked to early broadcast license renewals for eight ABC-owned stations.

The FCC requires these stations to prove their operations are in the public interest, focusing on diversity, equity, and inclusion (DEI) practices. Disney argues the FCC could have investigated these practices using other methods that do not include premature license renewals, which may escape legal scrutiny.

In a recent filing, ABC and Disney criticized the FCC’s decision for being an exceptional tactic meant to subject the company to immense pressure while avoiding judicial review. According to the filing, the FCC was urged by a court to outline alternative investigative methods it could have employed.

The FCC, represented by spokesperson Adam Jackman, rejected Disney’s filing as a strategic attempt to sidestep court processes. Jackman stated that Disney’s court claims only reflect an erroneous suit aimed at delaying the FCC’s oversight role.

Further conflicts arose over accusations that the FCC is retaliating based on ABC’s critical programs about former President Donald Trump. Disney argues FCC’s investigations are attempts to suppress speech, particularly targeting ABC’s late-night host Jimmy Kimmel and the daytime show “The View.” The FCC alleges “The View” must offer equal time to opposing political candidates, which Disney claims is not applicable due to its status as a bona fide news program.

Fox News sought comments from ABC and Disney but received no immediate responses.

The ongoing legal tussle draws attention to how media companies and regulatory bodies navigate issues of compliance while asserting their rights.
