Illegal Immigrant Indicted After Fatal Rollover Crash in Arizona

Authorities have indicted an illegal immigrant mother following a fatal rollover crash in Arizona. Toxicology reports indicated the presence of methamphetamine and marijuana in her system, as confirmed by Arizona prosecutors.

Incident Details

Brenda Rivera Estrada, 30, faced indictment over an April 12 crash on Interstate 17 near Cactus Road in Phoenix. The crash led to the death of her nine-year-old daughter, who was ejected from the SUV. Three other children in the vehicle — an 11-year-old boy, a three-year-old boy, and a one-year-old girl — sustained minor injuries.

Rivera Estrada’s daughter was reportedly sharing a seatbelt with a sibling at the time of the accident.

Legal Charges

Rivera Estrada faces charges including manslaughter and child abuse. Additional charges comprise endangerment, possession or use of dangerous drugs, and possession or use of drug paraphernalia. Her indictment followed the detection of marijuana odor at the scene by Arizona Department of Public Safety troopers, and subsequent confirmation from toxicology results showed she had used marijuana and methamphetamine.

A prosecutor disclosed, “The suspect chose to get in a vehicle while allegedly under the influence.” Witnesses claimed she drove above the 65 mph speed limit.

Immigration Status and Arrest

Rivera Estrada, identified as a Mexican national, initially entered the U.S. in 2009 as a nonimmigrant border crosser, allowed to stay for up to 30 days. However, she remained beyond this period, violating federal immigration law. She was apprehended by ICE after being released from local custody and held on a $250,000 cash bond after indictment. Her arrest underscores ICE’s Criminal Alien Program’s safety efforts.

Prosecutor’s Remarks

Maricopa County Attorney Rachel Mitchell defended the time taken for filing charges, explaining that complex cases require thorough investigation to ensure evidence can prove a case beyond a reasonable doubt. “We have one chance to get this right,” she stated.

Rivera Estrada remains detained as her legal proceedings continue.
