Nike and Diversity: Civil-Rights Investigation Under the Trump Administration

Nike, well-known for its commitment to diversity, has become a focal point for a civil-rights investigation initiated by Andrea Lucas, a commissioner on the Equal Employment Opportunity Commission (E.E.O.C.). Lucas, appointed by President Trump during his first term, raised concerns about alleged discrimination against white employees and job applicants.

In May 2024, Lucas sent a detailed 26-page memo to several agency officials, claiming Nike had systematically discriminated against white individuals over the years. Nike, renowned for its diversity targets and initiatives in its workforce and advertising campaigns, was accused of utilizing internal programs to enhance racial representation while allegedly reducing white executives through layoffs.

Lucas argued that if Nike’s employment decisions were influenced by race, including within its training programs, the company had violated federal law. Stressing the urgency of the matter, Lucas filed a charge that prompted a civil-rights investigation on the same day.

This probe is part of broader actions against diversity, equity, and inclusion (D.E.I.) initiatives viewed skeptically by the Trump administration. Lucas became a significant player in these efforts, rising to the chair of the E.E.O.C. and setting a precedent for similar investigations.

The E.E.O.C. has long scrutinized employers for potentially unfair practices based on race, sex, disability, or national origin. In parallel, the agency has also supported employers aiming to diversify their hiring pools, particularly after periods of discrimination where qualified applicants were overlooked for roles.
