Conservative activist Robby Starbuck has achieved a significant legal advancement against Google. On Friday, a Delaware Superior Court ruled that his defamation lawsuit could progress. Starbuck filed the suit in October, seeking a minimum of $15 million. He alleges that Google’s artificial intelligence (AI) programs defamed him, falsely depicting him as a ‘monster.’ These portrayals reached millions of users through ‘AI hallucinations.’
Judge Meghan Adams stated that the allegations are sufficient to support a claim for emotional distress damages at this stage of the proceedings. The court views these claims as adequately pled to proceed to discovery and further examine the allegations.
Starbuck expressed his optimism on social media, sharing his intent to uncover how such defamation occurred. He questioned whether there was political bias or negligence from programmers behind the AI. Starbuck emphasized the importance of discovery in revealing what Google knew and why the issues persisted.
In his statement to Fox News Digital, Starbuck described the court’s decision as historic. He stressed the growing influence of AI and the necessity to prevent it from harming individuals through defamation or potential physical harm in the future. He hopes this case will set a precedent for AI accountability.
Google did not immediately respond to a request for comment. The lawsuit points to Google’s AI platforms like Bard, Gemini, and Gemma as sources of false statements about Starbuck. Allegations include sexual assault, rape, and harassment claims. Notably, these statements were allegedly shown to 2,843,917 unique users. Starbuck was motivated to pursue legal action particularly when accused of child rape, feeling the accusations had escalated significantly.
The legal battle now moves towards discovery, where Starbuck and his legal team will seek to uncover more details about the role of political bias and decision-making within Google.
