The Supreme Court has decided to examine the constitutionality of a federal ban on home spirit distilling. This ban has been in place for almost 160 years, having been enacted in 1868 to prevent tax evasion.
Scott McNutt from Robbinsville, New Jersey, is challenging the ban. He argues that it infringes on constitutional rights. McNutt, who owns a still used previously for creating fuel alcohol, now wishes to experiment with distilling spirits at home.
