A lawsuit has been filed in the U.S. District Court for the Northern District of California, claiming that Anthropic, OpenAI, SpaceXAI, and Google conspired to slow down the advancement of their AI technologies. The lawsuit argues that these companies violated antitrust laws by agreeing to decelerate their progress, which potentially diminishes the value consumers receive from their AI subscription services.
The lawsuit points to a specific event on September 12, where Anthropic CEO Dario Amodei published an essay advocating for industrywide cooperation to slow AI progress for better safety measures. Amodei warned about the risk of uncontrolled AI agents potentially disrupting the internet within six months and recommended a cautious approach to technology development. His essay outlined a three-point plan aimed at “pacing the frontier.” During an interview with CBS News, Amodei expressed surprise over the rapid pace of AI progression.
On the same day, leaders from his rival companies—Sam Altman of OpenAI, Elon Musk of SpaceXAI, and Demis Hassabis of Google DeepMind—allegedly confirmed their participation in Amodei’s proposal, according to the lawsuit.
The plaintiffs argue that antitrust laws prohibit competitors from collectively deciding that competition is too dangerous.
The lawsuit is brought forward by lawyers representing four named plaintiffs who subscribe to services such as ChatGPT, Claude, Grok, or Gemini. They aim to represent a nationwide class of other subscribers. Nick Rowley, the lead attorney, emphasized the risks of AI spinning out of control and the dangers of private agreements dictating AI safety protocols.
Anthropic, OpenAI, Google, and SpaceXAI have yet to comment on the lawsuit. Amodei’s initial essay acknowledged the potential antitrust issues and suggested that the U.S. government could facilitate discussions between labs or issue a waiver for safety conversations.
During his CBS News interview, Amodei stated that building AI correctly would minimize risks while doing so incorrectly would elevate them.
