2 hours ago 0

A Canadian man named Mitchell Fairbarn was found guilty of animal cruelty charges after removing a flamingo from the Flamingo Las Vegas Hotel and Casino. The incident, considered a malicious prank by prosecutors, was described by the defense as drunken foolishness.

Incident Details

Fairbarn, a tourist from Ontario, Canada, captured the 27-year-old Chilean flamingo named Peachy on March 3, causing harm and fear to the bird. Defense attorney Josh Tomsheck argued that Fairbarn deeply regretted his actions, blaming intoxication for his poor decisions.

After five hours of deliberation, jurors delivered felony and misdemeanor convictions. This decision followed the review of 112 exhibits and testimonies from 14 witnesses.

Legal Consequences

Fairbarn remains under house arrest while awaiting sentencing set for December 1. He potentially faces up to four years in prison for the felony charge and an additional six months for the misdemeanor conviction. Neither Fairbarn nor his lawyer commented after the verdict.

Flamingo’s Condition

Peachy’s veterinarian, Tiffany Moore, reported that the flamingo is physically recovering but displays increased anxiety. During the trial, it was revealed that Peachy lost feathers and sustained injuries. Video evidence showed Fairbarn carrying and mishandling Peachy, which caused the bird pain.

Background of the Incident

Fairbarn attended a work event at Con Expo and consumed a large amount of alcohol. His actions were recorded on video, showing him taking Peachy from the enclosure and carrying it in an elevator and hotel hallway. Security staff later reported the incident, and police found Peachy missing feathers and injured.

During the trial, Fairbarn admitted he took the flamingo to his room but did not intend to torture it. He acknowledged that alcohol influenced his actions, and he made poor choices.

Public Reaction

Fairbarn received death threats after the incident, and events surrounding his trial impacted his ability to travel. Prosecutor Haley Willming emphasized that the consequences Fairbarn faced resulted from his actions.

Advocacy and Impact

Nevada animal rights advocate John Waudby praised the verdict as justice for Peachy. Waudby, instrumental in strengthening the state’s animal cruelty laws, expressed hope that the verdict sends a message against harming animals in Nevada.

The verdict highlights the seriousness of animal cruelty laws and reinforces accountability for such actions.
