New York State has implemented new immigration laws aimed at holding federal agents accountable for their methods. These laws stand against tactics employed by immigration agents that have sparked controversy.
Recently, New York lawmakers passed legislation prohibiting federal immigration agents from wearing masks during their operations. This decision emerged after past incidents in Lower Manhattan where agents wore masks, causing public concern. Governor Kathy Hochul announced these changes with the intention of increasing transparency.
However, the Trump administration is expected to challenge these state-level efforts. The Department of Homeland Security (DHS) has already suggested it will resist these new measures. An internal memo from DHS’s general counsel, reviewed by The New York Times, stated that agents were not legally obligated to adhere to state-imposed mask prohibitions. The memo encouraged agents to conduct their duties unaffected by state interference.
This memo follows a national movement seeking to limit federal immigration enforcement. The push for restrictions grew after tragic incidents involving immigration officers resulted in the deaths of two Americans in Minneapolis.
New York’s legislation is part of this wider trend. Besides banning masks, the laws provide for legal actions against Immigration and Customs Enforcement (ICE) agents for constitutional violations. It also restricts searching of designated “sensitive locations,” such as hospitals and schools, without a judge-issued warrant.
Jen Goodman, spokesperson for Governor Hochul, reinforced the state’s stance. “If you are enforcing the law, you should not be hiding from it,” she asserted. Goodman emphasized that any ICE agents violating New York’s laws will be held accountable.
