The federal prosecutor overseeing the Justice Department’s criminal case against former FBI Director James Comey has been replaced, as revealed in a recent court filing. Assistant U.S. Attorney Timothy Severo has taken over from Matthew Petracca in the Eastern District of North Carolina. The substitution notice did not disclose the reason for this change.
Comey faces two federal charges that could lead to a ten-year prison sentence. His charges stem from an Instagram post displaying seashells arranged to read ’86 47.’ This post is alleged to suggest harm to President Donald Trump, labeled as the 47th president. Prosecutors assert the post sends a harmful political message.
James Comey’s Instagram post is seen by authorities as a serious threat. ‘The grand jury returned an indictment alleging James Comey did just that,’ stated Acting Attorney General Todd Blanche. Despite his denial of any threatening intent, arguing the post was a political statement, the case continues toward trial.
Prosecutors believe the number ’86’ is used as slang for assassination in certain circles, not just a restaurant term. FBI Director Kash Patel emphasized that Comey, being a former FBI Director, was aware of the potential consequences of his actions.
Legal experts are skeptical about the prosecution’s success. Jonathan Turley, a constitutional law expert, expressed doubts, citing First Amendment protections likely favoring Comey. If charged, the case is expected to confront significant constitutional challenges.
The trial was postponed following U.S. District Judge Louise Wood Flanagan’s approval of Comey’s request for a delay. Meanwhile, Comey portrays these proceedings as politically biased and affirms his commitment to advocating for the rule of law.
