James Talarico’s Comments on Gender Identity and Parental Decisions Resurface

James Talarico, the Democratic candidate seeking a U.S. Senate seat in Texas, previously described the refusal of some parents to acknowledge their children’s gender identity as potentially “abusive.” During a 2019 committee hearing in the Texas Legislature, Talarico noted, “I think there are some folks that would think that if you deny your child’s gender identity, that’s incredibly harmful. And whether or not we label it with the term abuse, it’s abusive for sure.”

The resurfacing of Talarico’s statement may challenge his attempts to present himself as a moderate on gender, policing, and border security. These issues are pivotal as he campaigns to win over Texas, a state traditionally leaning Republican.

Disagreement Over HB 1910

At the hearing, Talarico opposed HB 1910. The bill aimed to ensure that parents who did not affirm their children’s gender identity were not automatically guilty of child abuse in custody cases. The text read, “In determining whether to appoint a party as a sole or joint managing conservator of a child, the court may not consider evidence regarding whether the party demonstrates a history or pattern of acknowledging or declining to acknowledge the child’s gender identity or expression.”

Talarico voiced concern about categorically excluding the lack of acknowledgment as non-abusive, stating, “My concern is ruling it out as not being abuse, I think, is dangerous and could certainly harm some of our most vulnerable kids in the state.”

Opposition and Political Repercussions

Some Republicans have criticized Talarico’s stance. Zach Kraft, a Republican National Committee spokesperson, said, “Only perverts and pedophiles think about what is in little kids’ pants as much as James Talafreako. He is a truly sick individual for dedicating his life to pushing sex changes on other people’s kids.” Although the specific bill version Talarico opposed failed in committee, a revised version passed the Texas House and became law in May 2025.

Talarico voted against this newer version and supported an amendment that proposed sunsetting the law in 2030, along with another amendment clarifying rejection of a child’s gender identity as abusive.

Talarico’s Campaign Stand

Talarico’s campaign emphasized his respect for parental rights. JT Ennis, a spokesperson for Talarico’s campaign, stated, “James believes parents have the most important say in decisions about their children, which is why he sponsored a bill to protect parental rights and ensure parents are responsible for the upbringing of their own kids.” Ennis also criticized Ken Paxton, Texas Attorney General and Talarico’s rival, suggesting Paxton has endangered Texas families.
