The couple, Nausheen Gilkar and Omar Ahmed, appeared in a Texas court, expressing distress over their parental rights being challenged. The surrogate, McKenna West, is seeking conservatorship, claiming the couple previously wanted to terminate the pregnancy.

The case has garnered attention from right-to-life advocates and some GOP officials, aligning themselves with West, a nurse who traveled to Texas to give birth. Texas’s strict abortion laws have added a layer of complexity to the dispute.

Gilkar and Ahmed named the child Rumi, while West refers to the baby as Gabriel. West’s legal team argues for sole conservatorship to make medical decisions, challenging the couple’s willingness to provide necessary medical care.

Rumi suffers from hypoplastic left heart syndrome, a rare and critical condition requiring immediate medical intervention. Attorneys for the couple reported the child’s health has worsened following surgery. The couple obtained a restraining order against West, preventing her from seeing the child. The court has yet to decide on custody or conservatorship.
“He’s the most beautiful person I’ve never seen,” Gilkar stated, highlighting the emotional toll on the couple.

During the court hearings, the surrogate’s attorney challenged the couple’s commitment to the child’s medical care, citing their previous request for an abortion. The surrogate contends her desire to protect the child’s life led her to disregard the couple’s demands.
Contractual Obligations
West is accused by the couple of breaching their surrogacy contract from August 2025. Gilkar described the challenges of their fertility journey, leading them to opt for surrogacy after exhausting other options. The couple’s legal team pointed to California court records affirming West has no custody rights.
