Former CIA Director John Brennan has been called to testify before a Florida grand jury. This is part of a Justice Department investigation into whether former law enforcement and intelligence officials conspired against President Donald Trump. Additionally, Brennan faces an inquiry into alleged false statements made before Congress.
Ken Wainstein, Brennan’s lawyer, revealed the subpoena while seeking a court order to ensure the Justice Department preserves all related records. He argued that these documents are crucial for challenging any potential prosecution of Brennan as unfair. Wainstein highlighted the unusual nature of the request, stating that he had never seen a situation like this in his experience at the Justice Department.
During a hearing with U.S. District Judge Jia Cobb, Wainstein pointed out alleged judge-shopping by the Justice Department and directives from Trump targeting perceived adversaries, including Brennan. He mentioned that the investigation appears to involve questionable tactics.
The scope of the subpoena
Brennan must appear before the grand jury on October 15 in Fort Pierce, Florida. This location is significant as it is under the jurisdiction of Aileen Cannon, a judge who previously dismissed charges against Trump related to classified documents.
The subpoena is linked to a broad investigation examining whether government officials conspired against Trump, including during the Russia election interference probe in 2016. Brennan is also under investigation for allegedly lying about a U.S. intelligence assessment on Russian interference in favor of Trump, an accusation he denies.
Resignation of lead prosecutor
Joe diGenova, who was heading the “grand conspiracy” investigation, resigned, reportedly due to dissatisfaction from the Justice Department and the White House regarding the investigation’s management. DiGenova, clarifying past comments, stated that evidence exists in these cases but takes time to develop.
The Justice Department has yet to announce his replacement. Kurt Olsen, a lawyer involved in the investigation, previously pushed the Justice Department to support Trump’s false 2020 election claims.
Brennan’s defense requested communications indicating any direction from Trump or White House officials concerning the pursuit of Brennan. They asserted that the preservation of records is crucial, citing failures by the Trump administration to keep such documentation.
The Justice Department responded that Brennan’s request is speculative, as he is not a criminal defendant, and it is unclear if he will ever be charged. Judge Cobb has not yet ruled on Brennan’s request.
