In the wake of a federal judge’s decision to overturn policies from the Trump era, there is a renewed optimism surrounding the movement of immigration applications that had been stalled. However, the timeline for progress remains uncertain.
Immigrants have faced a backlog of over a million applications related to citizenship, green cards, work permits, and asylum. The timing for when these applications will advance is still unclear.
In a recent opinion, Judge John J. McConnell Jr. criticized the Trump administration’s policies, stating they had created substantial barriers for immigrants aiming to remain in the United States. He emphasized that these policies essentially froze the lives of many due to their countries of birth.
The policies by U.S. Citizenship and Immigration Services paused asylum applications and decision-making for immigrants from 39 countries, primarily in Africa and the Middle East, under a travel ban. Judge McConnell noted, “More fundamentally, the challenged policies placed the lives of countless individuals on hold — solely by virtue of their countries of birth.” He highlighted that many affected individuals still lack work, legal status, and the ability to plan their futures.
This ruling marks a win for labor groups that filed a lawsuit against the federal government in March over these policies. The American Gateways nonprofit, which offers legal assistance to immigrants, was one such group involved in the lawsuit.
