Federal Judge Strikes Down Trump-Era Immigration Policy

A federal judge in Boston declared a Trump-era immigration policy unlawful. This policy, enacted after a National Guard shooting, made it more difficult for immigrants from several countries to stay or enter the United States. The ruling, delivered by U.S. District Chief Judge John McConnell Jr., criticized the U.S. Citizenship and Immigration Services (USCIS) for overstepping its legal authority and neglecting required procedures.

Judge McConnell stated that the policy placed many immigrants in legal uncertainty. He accused the USCIS of using national security concerns as a pretext, obscuring underlying anti-immigrant biases. According to the judge, the actions of USCIS were both arbitrary and against the law.

The Department of Homeland Security did not immediately provide a response to the ruling.

The policy targeted immigrants from 39 countries across Africa, Asia, Latin America, and the Middle East. It prohibited them from obtaining final decisions on asylum, work permits, green cards, and citizenship applications. Skye Perryman, representing the plaintiffs through Democracy Forward, emphasized that the ruling confirms the government cannot lawfully restrict immigration pathways or discriminate based on national origin.

This decision is especially relevant for cases within the USCIS, impacting all pending applications from the restricted countries. Shev Dalal-Dheini from the American Immigration Lawyers Association highlighted the significance of this legal win in upholding legal immigration pathways.

The policy emerged from efforts to tighten U.S. immigration and entry standards. It excluded those stopped at the border, who continue to have their asylum claims assessed separately by immigration judges.

The ruling challenges the government’s stance that the executive branch has wide authority over immigration policy. The government argued that it requires broad discretion to guide policy, but the court’s decision keeps USCIS accountable to federal law and congressional mandates.

Immigration advocates, including Jamal Abdi from the National Iranian American Council, hailed the decision as evidence that policies must adhere to laws defined by Congress. The ruling reassures law-abiding immigrants who rely on these legal pathways.

Navy veteran Shawn VanDiver, leading Afghan resettlement support, shared stories of affected individuals. He described the challenges faced by immigrants dealing with delays in work permit renewals, postponed plans, and stalled citizenship applications. This decision marks a significant victory for maintaining legal norms and assisting eligible immigrants.
