Legal Dispute Resolution Brings New Developer Interest

Parties involved in the prolonged legal battle over the stalled hotel project in downtown Skokie are exploring options to resolve financial claims. This could help push the development forward, according to Village officials. Attorney Rodney Lewis relayed a message at the recent Village Board meeting, indicating that efforts to settle the litigation have piqued the interest of several potential developers.

“We have firm commitments from everyone involved that they’re willing to either discount their claims or walk away from their claims to make this happen,” Lewis said.

The obstacle is finding a developer who believes the financial aspects are viable. Economic Vitality Manager Rodney Tonelli mentioned that discussions with numerous developers have resulted in ongoing conversations with seven interested parties.

Complex Economic Challenges

Tonelli revealed that three developers are in the process of examining the financial feasibility. He stated, “Ultimately, it’s a math problem for the economics of the project.” Attorney Lewis emphasized the importance of keeping all parties engaged in negotiations.

The hotel construction at 4930 Oakton Street in Skokie initially stopped in 2023. Russell Construction filed a lawsuit against E&M Strategic Development over unpaid project costs for the intended Homewood Suites by Hilton.

Financial Contributions and Project Setbacks

In attempts to address financial issues, Skokie approved a $4.5 million loan from its Economic Development Fund. However, additional funding never materialized, keeping the loan pending. Skokie’s financial contribution, including $10.5 million in Tax Increment Financing funds, was contingent on securing necessary project financing.

In 2025, lender X-Caliber Capital sued E&M Strategic Development for defaulting on the construction loan due to cost overruns, leaving the site in foreclosure.

Upcoming Arbitration Hearing

An arbitration panel has granted Russell Construction’s claim priority over X-Caliber’s. The next hearing for all involved lienholders is set for September. The Village has been engaged from the sidelines, avoiding direct litigation costs.

Lewis highlighted the Village’s role in encouraging stakeholders to realize the benefit of resolving the litigation. This shift has drawn new developer interest, suggesting a potential path forward for the project.

Structural Integrity and Future Evaluations

Questions about the structural integrity of the hotel building arose during the meeting. Tonelli responded that a structural engineer assessed the site, noting it remains in good condition but requires continued monitoring. Further evaluations are planned before winter.

Skokie Mayor Ann Tennes expressed frustration over the project’s delay and its effect on the community. Acknowledging staff efforts, she anticipated an update on progress in September.
