Federal Judge Quashes Subpoenas Against Minnesota Officials

A federal judge has nullified six grand jury subpoenas issued by the Trump administration against Minnesota state and local governments. U.S. District Judge Patrick Schiltz declared the subpoenas retaliatory and invalid.

The Ruling

Judge Schiltz concluded that the subpoenas intended to pressure Minnesota officials, including Gov. Tim Walz and Minneapolis Mayor Jacob Frey, into cooperating with immigration enforcement. This followed their legal challenge to Operation Metro Surge, a federal immigration initiative. Schiltz emphasized that using grand jury proceedings in this manner is both unlawful and unethical.

The judge’s ruling clearly states, “The Court has no doubt that they were issued for these forbidden purposes.” He highlighted the Justice Department’s failure to provide a legitimate investigatory basis for the subpoenas.

Operation Metro Surge

Operation Metro Surge was an immigration enforcement effort by the Trump administration that prompted legal opposition from Minnesota officials. The subsequent subpoenas were perceived as a response to resist the judicial process.

Officials’ Responses

Gov. Walz described the ruling as “a victory for the rule of law and our democracy.” He stressed the necessity of upholding justice amidst what he perceives as increasing lawlessness.

Attorney General Keith Ellison criticized the administration’s actions, asserting the subpoenas were “politically motivated retaliation.” He raised concerns regarding the alleged misuse of the criminal justice system for political purposes.

Minneapolis Mayor Frey echoed similar sentiments, condemning the subpoenas as an attack on democratic principles. He affirmed that challenging government authority should not invoke retribution.

A Department of Justice spokesperson did not provide a comment when contacted.
