Homeland Security Clarifies Immigration Policy on Green Card Applicants

The Department of Homeland Security recently sought to clarify its stance on a policy affecting immigrants seeking permanent residency. This follows an earlier announcement suggesting that such individuals must return to their home countries to await their green cards, aside from some ‘extraordinary’ exceptions.

On Friday, the department emphasized that this is not a sweeping policy change. A spokesperson highlighted that discretion has always been with immigration officers, allowing them to decide on a case-by-case basis whether an individual must return abroad to complete the green card process.

The original announcement appeared as a partial walk-back, creating some confusion. The longstanding policy permitted immigrants to stay in the U.S. while awaiting green cards. The new clarification reiterated that only specific cases might require individuals to leave temporarily, such as those who overstay visas or come from countries with high reliance on public assistance.

A Homeland Security spokesperson noted, “This was just a reminder to officers of their discretionary authority, which has always existed.” However, the spokesperson, who declined to be named, acknowledged that the clarification has not eliminated confusion or fear among potential green card applicants.

Internal sources say the clarification was intended as a housekeeping measure rather than a strategic change. Despite the efforts to address concerns, the specifics remain unclear, leaving many to wonder about the actual implications. Internally, even some department staff were uncertain about the changes when the announcement first circulated.
