Massachusetts Expands Abortion Rights with New Legislation

On Monday, Massachusetts Governor Maura Healey enacted a new law granting doctors the authority to determine whether abortions may proceed later in pregnancies. This decision positions Massachusetts as the 10th state allowing the procedure without any gestational limit.

The legislation, known as the Prioritizing Patient Access to Care Act, dismantles the previous restrictions on abortions beyond 24 weeks. The prior regulation permitted such procedures only under conditions like preserving the patient’s life or health or addressing severe fetal anomalies. The current law simplifies this, allowing for the procedure based solely on the physician’s professional judgment.

“I’ve heard heartbreaking stories from women and families who were preparing to welcome a healthy baby into their family, only to receive devastating news later in their pregnancy,” Governor Healey shared. “Instead of being able to rely on the doctors they knew and trusted at home, they were forced to travel hundreds of miles and pay out of their pockets while navigating unimaginable grief.”

Governor Healey, a Democrat, emphasized the importance of women making healthcare decisions in consultation with their doctors. She noted, “This law continues our efforts to have the strongest abortion protections in the country, because in Massachusetts, we believe health care decisions should be made between women and their doctors.”

According to health policy research organization KFF, Massachusetts joins nine other states that have no gestational limit on abortion. These states include Alaska, Colorado, Maryland, Michigan, Minnesota, New Jersey, New Mexico, Oregon, and Vermont, along with Washington D.C.
