President Donald Trump’s ongoing conflicts with Senate Republicans have led to several setbacks for his administration’s legislative efforts. Analysts have observed a pattern of self-imposed obstacles that are delaying progress on Capitol Hill.

Delays in Key Nominations

Recently, Trump announced a hold on Jay Clayton’s nomination for director of national intelligence (DNI) until his choice for U.S. attorney for the Southern District of New York (SDNY) is confirmed. This decision means that Bill Pulte will continue as acting DNI, complicating the reauthorization of FISA Section 702. This sets an example of Trump hampering his own legislative priorities.

Trump’s administration has taken actions, such as the anti-weaponization fund and a Department of Justice (DOJ) probe against Jerome Powell, that have impacted relationships with Senate Republicans. As the midterms approach, Trump and Republicans might feel compelled to advance parts of his agenda while still holding both chambers.

Upcoming Midterm Concerns

Democrats are likely to regain control of the House of Representatives, and the Senate remains competitive. If Republicans lose either chamber, implementing Trump’s agenda becomes significantly harder. Mark Rozell of George Mason University warned that losing control could lead to Republicans fighting for survival in 2028 under a less popular Trump.

“Once they lose control of one or both legislative chambers, it will all be about Republican members fighting to survive,” Rozell told Newsweek.

Olivia Wales, a White House spokesperson, asserted Trump’s leadership within the Republican party, emphasizing his commitment to maintaining congressional majorities.

FISA Section 702 Reauthorization Challenges

Trump’s halt on Clayton’s nomination will influence congressional activities, notably with Pulte remaining as acting DNI. Concerns about Pulte’s qualifications and his role in intelligence oversight linger, with Democrats opposing FISA renewal under his tenure.

“Bill Pulte is deeply unqualified to serve as acting director of national intelligence,” House Democratic Leader Hakeem Jeffries stated.

FISA Section 702 allows U.S. intelligence to collect data on foreign targets outside the U.S., sometimes involving Americans. While some view it as crucial for counterterrorism, others believe it violates privacy. Trump’s approach may complicate reaching a FISA deal, potentially blocking legislative movements.

Political Challenges for Trump

Senator Richard Blumenthal accused Trump of creating chaos in the intelligence community. Senator Chris Coons expressed concerns over Pulte’s lack of experience in national security roles.

Trump’s choices are stalling the GOP’s agenda, despite previously backing down in similar situations. DOJ’s probe into Jerome Powell and the anti-weaponization fund have also sparked criticism, demonstrating administrative challenges.

Republican Division and Future Dynamics

Some Republicans have started opposing Trump’s agenda more openly as the midterms approach. Todd Belt from George Washington University suggested that the GOP often aligns with Trump’s views. However, a deteriorating relationship between Trump and leaders like John Thune could lead to further complications.

With Trump’s declining approval ratings and economic issues tied to international conflicts, Republicans in competitive races may distance themselves from an unpopular president. Already, some Republicans feel less threatened by opposing Trump due to changes in the political landscape.

John Cornyn and Bill Cassidy serve as examples, having faced challenges in their renomination contests. Observers are watching key senators like Thom Tillis, who shows increased willingness to defy Trump.

Awaiting Senate Decisions

The future of the party’s agenda in Congress remains uncertain after Trump’s pause on the Clayton nomination. The potential loss of seats during the midterms raises stakes for impending legislative activity.

Mark Rozell highlighted increased difficulty for Republicans in the latter part of Trump’s term as Democrats gain more tools to counter the president’s plans.
