Washington Wrestler’s Supreme Court Relief Request Challenged

49 minutes ago 0

Background

Washington education officials have urged the Supreme Court to reject a teenage wrestler’s request for emergency relief related to transgender competition. The wrestler, Kallie Keeler, claims she was sexually assaulted by a transgender opponent and seeks to avoid similar matchups.

State’s Argument

Attorneys for the Office of Superintendent of Public Instruction and Superintendent Chris Reykdal dismissed the urgency of the family’s petition, citing the absence of a real emergency. The state’s response highlights the six-month gap between the alleged incident and the lawsuit, questioning the timing for seeking injunctions.

The ‘irreparable’ nature of the claimed harm is manufactured. Applicants have sought emergency relief three times despite there not being any true emergency.

Legal Proceedings

Keeler’s request for an injunction was previously denied by a district judge and the Ninth Circuit. Her family now seeks to compete without facing male athletes or receive protections allowing opt-out options.

Additional Defendants

Alongside the state, Puyallup School District and the WIAA submitted opposition filings. The district claims it provided sufficient accommodations, and the WIAA argues it does not fall under Title IX due to its private nonprofit status.

Upcoming Ballot Measure

The state suggests deferring Supreme Court involvement pending Washington’s voter decision on Initiative IL26-638, aimed at regulating athletic participation based on biological sex.

Parental Rights and Title IX

The state disputes the family’s parental-rights theory, asserting it would improperly allow parents to dictate school athletic rules.

WIAA’s Defense

The WIAA maintains it lacks control over federal funding schools’ athletic programs. It denies imposing penalties on Keeler, highlighting that penalty discretion mainly applies to postseason events.

Legal Context

The responses reference the Supreme Court’s West Virginia v. B.P.J. ruling on sex-based restrictions, emphasizing the ongoing uncertainty regarding Title IX’s applicability to transgender athletes.

Family’s Broader Goal

Keeler’s attorneys aim for a nationwide Title IX ruling requiring protected female athletic categories. Concerns about Keeler’s limited time to compete underscore the urgency of their legal pursuit.
